SHON Y BUILDS agrees to provide construction services as detailed in the specific project proposal or contract agreed upon by both parties. This includes labor, materials, equipment, and supervision necessary for the completion of the work. Any changes to the scope of work must be agreed upon in writing through a Change Order.
Payment schedules will be outlined in the project contract. Typically, this involves a down payment, progress payments at specified milestones, and a final payment upon completion. Late payments may be subject to interest charges as permitted by law. All materials remain the property of SHON Y BUILDS until paid for in full.
The client may request changes to the work. All such requests must be submitted in writing. SHON Y BUILDS will provide a written estimate of the cost and time implications of the change. No change will be implemented until a formal Change Order is signed by both parties.
SHON Y BUILDS will use its expertise to assist the client in obtaining all necessary building permits. However, the client is ultimately responsible for the cost of said permits. The client is also responsible for ensuring that the project location is accessible and that the proposed work does not violate any zoning laws or homeowner association rules.
SHON Y BUILDS will maintain comprehensive general liability insurance and workers' compensation insurance. A certificate of insurance can be provided upon request. The client is responsible for maintaining property insurance for the project site. In no event shall SHON Y BUILDS be held liable for any indirect, consequential, or special damages arising out of or in any way related to our services.
SHON Y BUILDS warrants that all work will be performed in a professional and workmanlike manner, in accordance with industry standards. We provide a one-year warranty on craftsmanship from the date of substantial completion. This warranty does not cover materials, which are typically covered by manufacturer warranties, nor does it cover damage caused by abuse, neglect, or acts of God.
Should any dispute arise between the parties, they agree to first attempt to resolve it through good-faith negotiation. If negotiation fails, the parties agree to enter into mediation before pursuing litigation. The prevailing party in any legal action shall be entitled to recover its reasonable attorney's fees and costs.
Either party may terminate the contract with written notice if the other party is in material breach of these terms. The client will be responsible for payment for all work completed up to the termination date, plus any costs incurred by SHON Y BUILDS for materials ordered or subcontractors engaged.
These Terms will be governed by and interpreted in accordance with the laws of the local state/jurisdiction, and you submit to the non-exclusive jurisdiction of the state and federal courts located therein for the resolution of any disputes.
